Comptroller Brad Lander Celebrating Deliveristas’ Minimum Pay Victory

New York, NY – Today, food app delivery workers won the nation’s first minimum pay rate after the Supreme Court of the State of New York Appellate Division, First Judicial Department denied the appeal filed by third-party app companies. New York City Comptroller Brad Lander, then Council Member, was the lead sponsor of the bill to establish a minimum pay for deliveristas.

“Today deliveristas won a monumental, long-overdue minimum pay rate that they so rightly deserve. As essential workers with grueling conditions, they deserve a pay standard that is not dictated by the whims of apps companies or by how many food orders they can achieve in an hour. These workers deserve secure pay that allows them to put food on their own tables while delivering food to our doors.”

Background 

Local Law 115 passed in September 2021. Department of Consumer and Worker Protection (DCWP) initially proposed rules in November 2022. The January 1, 2023 deadline passed without a rule in place, so delivery workers did not receive the raise they were owed by law.

After extensive lobbying by DoorDash, Grubhub, and Uber, DCWP issued a second, revised set of rules in March 2023 that reduced the pay formula by more than $3 an hour and will result in an average base wage of just $12.69 per hour after expenses.
